Terms & Conditions

These terms set out the basis on which Kinwell offers its household communication and document organisation programmes to families and households in Malaysia. Reading them helps you understand what to expect from us, and what we ask of you.

Definitions

In these Terms and Conditions, the following words carry the meanings given below:

  • "Kinwell" / "We" / "Us" / "Our" refers to Kinwell, operating from Suite 18-1, Wisma Cosway, Jalan Raja Chulan, 50200 Kuala Lumpur, Malaysia.
  • "Service" means any programme, workshop, session, or consultation offered by Kinwell, including the Household Conversation Workshop, Family Records and Contact Setup, and Year-Round Household Planning Programme.
  • "You" / "User" / "Participant" means any individual or household that accesses our website, registers for a programme, or engages with our services.
  • "Agreement" means these Terms and Conditions together with any booking confirmation or programme agreement issued by Kinwell.
  • "Content" means all text, materials, worksheets, templates, and resources provided as part of a Kinwell programme.
  • "Session" means a scheduled in-home or group meeting conducted by a Kinwell facilitator.

Acceptance of Terms

By accessing this website, submitting an enquiry form, or registering for any Kinwell programme, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

Our programmes are designed for adults aged 18 and above who have the legal capacity to enter into binding agreements. If you are registering on behalf of a household, you confirm that you have the authority to do so.

If you do not agree with any part of these terms, you should not proceed with registration or use of our services.

Service Description

Kinwell offers educational and organisational programmes for families and households. Our current programmes are:

  • Household Conversation Workshop — a guided three-hour educational session for couples and families wishing to develop steadier ways of discussing shared household plans.
  • Family Records and Contact Setup — a three-session in-home programme that helps families establish a shared records folder, family timeline, and printed contact list.
  • Year-Round Household Planning Programme — a twelve-month programme comprising an initial setup session, four quarterly group sessions, and a closing annual review.

All programmes are available to households in Kuala Lumpur and the Klang Valley. Availability in other areas of Malaysia is subject to facilitator scheduling and prior arrangement.

Kinwell reserves the right to modify programme content, format, or pricing with reasonable notice. Material changes will be communicated by email to registered participants.

Enrolling in a Programme

Enrolment is confirmed when Kinwell issues a written booking confirmation following receipt of the required deposit or full payment. Until that confirmation is issued, your place is not reserved.

You are responsible for ensuring that all information provided at enrolment — including household size, address, and contact details — is accurate. Inaccurate information may affect our ability to deliver sessions as planned.

Account-style login is not required for our programmes. Communication is conducted via email and telephone using the contact details you provide.

Your Responsibilities

As a participant in a Kinwell programme, you agree to:

  • Attend sessions at the agreed times and provide reasonable notice if rescheduling is needed.
  • Ensure that the home environment is reasonably safe and accessible for our facilitator during in-home sessions.
  • Use programme materials and Content for your household's personal, non-commercial purposes only.
  • Refrain from recording, photographing, or distributing session materials without our written consent.
  • Engage with our facilitators respectfully and in good faith.
  • Refrain from attempting to share login credentials or programme materials with households that have not enrolled.

Kinwell reserves the right to withdraw from a programme engagement if participant conduct makes continued delivery impractical or unsafe.

Intellectual Property

All worksheets, templates, frameworks, written guides, and other Content provided as part of a Kinwell programme remain the intellectual property of Kinwell. By enrolling, you receive a limited, non-exclusive, non-transferable licence to use those materials for your own household purposes.

You may not reproduce, adapt, distribute, or commercially exploit any Kinwell Content without our prior written consent.

Materials you create during sessions — such as your household's own timeline, folder labels, or contact list — belong to your household. Kinwell claims no ownership over the personal information you compile using our frameworks.

Payment & Fees

Programme fees are quoted in Malaysian Ringgit (RM) and are as follows at the time of these Terms:

  • Household Conversation WorkshopRM 540

Payment is accepted via bank transfer or such other methods as Kinwell advises at the time of booking. A booking deposit may be required to confirm your first session date.

Cancellations and rescheduling: If you need to cancel or reschedule a session, please give us at least 48 hours' notice. Sessions cancelled with less than 48 hours' notice may be charged in full. Sessions cancelled with adequate notice will be rescheduled at a mutually convenient time. Programme fees are non-refundable once delivery has commenced, except where Kinwell is unable to fulfil its commitments.

Kinwell does not currently offer instalment plans unless separately agreed in writing prior to enrolment.

Programme-Specific Terms

Household Conversation Workshop: The workshop is delivered as a single three-hour in-person session. It is designed as an educational experience and does not involve ongoing facilitator support beyond the session itself. Participation of two or more household members is recommended for the workshop to be most useful.

Family Records and Contact Setup: This programme involves three in-home sessions scheduled at intervals agreed between the household and the facilitator. The household is responsible for gathering and providing existing documents needed for the records folder. Kinwell provides labelling, structure, and guidance; the completeness of the final folder depends on the information the household is able to supply.

Year-Round Household Planning Programme: The twelve-month programme commences with an initial setup session and continues with quarterly group sessions at agreed dates. If a household needs to pause the programme due to personal circumstances, we will make reasonable efforts to accommodate a brief pause. Extended pauses of more than eight weeks may affect the programme rhythm; adjustments will be discussed individually.

Disclaimers

Kinwell programmes are educational and organisational in nature. They are not a substitute for professional legal, financial, psychological, or any other licensed professional advice. Our facilitators share communication frameworks and organisational tools; they do not interpret individual household circumstances or advise on legal, financial, or clinical matters.

Outcomes from our programmes depend on the engagement and effort of participating household members. Kinwell does not make promises about specific changes in household communication or document completeness as a result of participation.

Our website and programme materials are provided on an "as available" basis. We take care to keep information accurate, but we do not warrant that all content is free from errors or omissions at all times.

Limitation of Liability

To the extent permitted by Malaysian law, Kinwell's total liability to you in connection with any programme shall not exceed the fees you have paid for that programme.

Kinwell shall not be liable for indirect, consequential, or incidental losses arising from your participation in or reliance on our programmes, including but not limited to any household decisions made following participation.

Where circumstances beyond our reasonable control — including illness, natural events, or other force majeure situations — prevent us from delivering a scheduled session, we will arrange an alternative date at no additional charge.

Indemnification

You agree to indemnify and hold harmless Kinwell, its facilitators, and associated personnel from any claims, losses, or expenses arising from your breach of these Terms, your misuse of programme materials, or any false or misleading information you provide at enrolment.

Termination

Either party may end a programme engagement by giving written notice. If you choose to discontinue a programme that has already commenced, fees paid for completed sessions are non-refundable. Fees paid in advance for sessions not yet delivered will be refunded on a pro-rated basis.

Kinwell may terminate a programme engagement immediately if a participant's conduct is abusive, threatening, or makes continued delivery unsafe or impractical.

Sections 5, 6, 9, 10, 11, and 13 of these Terms survive termination of any programme engagement.

Dispute Resolution

These Terms are governed by the laws of Malaysia. Any disputes arising from your use of our services shall be subject to the jurisdiction of the courts of Malaysia.

Before commencing formal proceedings, we encourage you to contact us first at [email protected] so that we may try to resolve the matter informally. We will endeavour to respond to all written complaints within ten business days.

If informal resolution is not possible, the parties may agree to seek mediation through an appropriate Malaysian mediation body before resorting to litigation.

General Provisions

  • Entire Agreement: These Terms, together with any booking confirmation, constitute the entire agreement between you and Kinwell for the relevant programme.
  • Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
  • No Waiver: Our failure to enforce any provision on one occasion does not waive our right to enforce it on any other occasion.
  • Assignment: You may not transfer your programme booking or rights under these Terms to another party without our written consent. Kinwell may assign its rights in the event of a business transfer.
  • Notices: Notices under these Terms should be sent by email to [email protected] or by post to our registered address.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or organisational practices. The updated Terms will be posted on this page with a revised "Last Updated" date.

For participants currently enrolled in a programme, we will give at least 14 days' notice of material changes by email. Your continued participation in a programme after that notice period constitutes acceptance of the revised Terms.
